OK Supreme Court: Ten Commandments Monument Unconstitutional

Court Orders the Removal of the Monument Immediately

The Ten Commandments Monument that was ordered removed today by the Supreme Court of Oklahoma.

Oklahoma City, OK—The Oklahoma State Supreme Court has ruled that the controversial Ten Commandments monument placed on state capitol grounds is a violation of the Oklahoma Constitution and ordered its removal.

“This is a victory for anyone who values religious neutrality from their government,” said American Atheists President David Silverman. “The Ten Commandments have no place in government. They are incompatible with the protections of our Constitution and, as the Court rightly said, are obviously religious.”

American Atheists worked with the American Civil Liberties Union of Oklahoma throughout the litigation of this case, filing a companion case in Federal District Court.

“These monuments are unconstitutional, plain and simple. There is no question,” said Amanda Knief, National Legal and Public Policy Director of American Atheists. “We will fight any attempt to use government resources to advance religion, whether it’s happening in Oklahoma City or Washington, D.C.”

Added Silverman, “This is another example of Christian legislators thinking that their religion is somehow special. It isn’t. The Ten Commandments aren’t any more relevant than the statue of Baphomet proposed by The Satanic Temple. The sooner these lawmakers figure that out, the better.”

“We’re taking on these monuments wherever they are. If governments violate the Constitution, we will to take them to court, and we will win, just as we did in Starke, Florida.”

American Atheists has just filed suit in Levy County, Florida, challenging the installation of a Ten Commandments monument at the county courthouse.

            This is because it is AGAINST THE LAW. The establishment clause has been interpreted by the Supreme Court of the United States to mean that “no government shall endorse one religion or another or over non-religion”. Putting a statue of the ten commandments (a purely Christian concept) IS PROMOTING one religion over another and thus should not be allowed.

            If this monument were in front of the city’s Church and paid for by the churches money then not a single person would complain about it.

          Strangely, these ideas about “don’t murder, steal, or fuck around on your spouse” aren’t just engraved on your tablets. They show up in other religions and even cases where laws are NOT based on religion as well, even as far back as the code of Hammurabi, which predates Christianity. That is, they’re human concepts of lawfulness, not some kind of divine commandment from God. To inject a specific religion into reasoning out those laws is to corrupt them into a way to enforce said religion on unbelievers- the perfect recipe for hatred and discord.

        Nevertheless, US currency says in “God we Trust” so whether you’re religious or not that should not offend anyone -all that indicates to me is that there are rules in this country that are based on morality and principle. Removing the statue of commandments is similar; it may not be there but the system is based on it and no doubt it needs some updating to reflect the global and modern civilization. We are all different and mixed unlike in other countries with less diversity and that’s what makes it challenging to have one set of rules that will only confirm to everyone , not just majority. This weeks been flexing of political muscles which opens many other loopholes such as if gay couples can me naturalized. I would not like to live in a predominantly gay country for obvious reasons but I don’t mind living and tolerating people from all walks of life as long as they accept the existing values of the majority and do not try to change it.

      Fun fact: We came over here because “Christians” crowing the same line you are decided our forefathers weren’t the right kind of Christians and proceeded to use those self-same Commandments as the basis for beating them over the head, taxing one “Christian” more than another, and so on in a centuries-long cycle of abuse-in-the-name-of-God. And now, in your pompous ignorance, are deciding the same. We are not a “Christian nation”- we are a nation of free people, many of which belong to one Christian faith or another, but certainly nowhere near all- which is all the more fun as each considers themselves the “one true faith” whilst the other Christians get it wrong.

      We based our laws on the freedom FROM those laws being based on religion, not by kissing the tablets of Moses as if loving “God” (defined any way you like) was required for a law to be lawful.

      To enshrine a religion as the fountain of lawfulness points a finger that states “any who do not follow it are NOT lawful”. Shall we start tossing the Hindus into jail for being inevitable criminals for not being part of our “Christian” nation? Perhaps the Jews. Oh, and which Christian faith should we hold to be the bulwark of law, so we can make sure to get rid of the false ones so they don’t end up right next to the Mexicans on Trump’s list of neer-do-wells?

      America goes down the drain when we use “I’m better than you because I’m a Bible-bearer” vs. “We should all just mind our own fucking business” regarding religion and just plain do BETTER by each other.

      Steven, our laws are based mostly on European traditions including the Magna Carta and other documents, with a smattering of Native American traditions thrown in. Our civil government is constitutionally secular as it is prohibited from promoting or practicing religion. America is, and always has been, made up of many Christian individuals alongside many people of other faiths. We may be a “nation of Christians” but we are not a “Christian nation” since Christianity never has had any legal role in our government.

      I remember back in the 1950s when the old foggies would sit around talking about how immorality is destroying America. They were wrong, of course, and I see that some things never change.

I am not sure where you are from….but in any event, I’m pretty certain that your local community college has some night classes on Introduction to the Constitution and American History that you could take….if your church can spare your knees for a night or two a week, that is. If you actually do decide on going for some of those classes, a remedial English class may also be helpful with writing and spelling basics, as well, because when you write things like “what are current laws are based on…” Jeez, literal nails on the blackboard! A few classes would really help your arguments come across as more learned and less neanderthalic and knee-jerk, as well. I really wish you luck with your endeavors.

      American law is not based on the 1st Commandment, as this is specifically prohibited by the US Constitution. Likewise, the laws of this country make adherence to the 2nd, 3rd, 4th, 5th, or 10th any of their business, nor should it, for this would make my country a theocracy! The 7th and the 9th have only limited legal application in our legal system, and this leaves only two of your 10 Commandments with full legal application in American law, which is so only because there have never been any civil societies throughout human history with laws which run counter to them (6 and 8)! Hate to break it to you, but there’s really nothing special about the idea that law should not tolerate theft or murder, and it’s probably a good idea for everyone to honor their parents and not cheat on their spouses!

    Sorry for going of topic. My daughter has become brain washed and manipulated by a Christian family. She now plans to marry into this family and wont listen to any reason. I have tried to talk to her but no luck. I need help.

      Freedom includes the right to make decisions others may deem a mistake or choices we might disagree with. That includes religion. If the man she loves and the family she’s joining isn’t trying to split her away from her parents…let it be. Be the better adult and maturely discuss her new experiences and let them reflect off your own. If she hasn’t experienced what it’s like being part of a religious social group, this is going to also be something of a novelty, and the novel attracts attention, especially when younger.

      And it’s easier to be there IF something goes off the chain if you aren’t sitting there being an obvious rock in the road towards exploring this bit of life (and hence a reason to keep distance between you and your daughter).

      This is American Atheists a group FOR atheists, not the cult deprogramming/exit counseling website. And yes, my posts sounds harsh, but what on earth are YOU thinking?
      Anyway, look up Steve Hassan on google and youtube. But also keep in my mind that if your daughter is an adult there is not much you can do about her choices as bad as they may be. Just don’t cut off contact to your daughter, then this family has already won.

    I thought our nation was built and founded on the premise of freedom of religion. That is what the revolutionary war was all about. It was never stated anywhere in the government that this was a nation of any religious affiliation. At least that is what I remember back in history class in high school.
    Now for the ten commandants. They are of religious significance not government significance so why should they be displayed on government grounds. I believe in the ten commandants. I believe it is a blueprint that helps people do the right things. But alot of those commandments are outdated even though they may be right to certain people. How many Christians work on Sunday? How many Christians be respectful to their parents? How many Christians don’t commit adultry. How many Christians bare false witness against there neighbor. So don’t be saying that Christians are all holy than thou..

      Sorry, but you must have sucked at History in high school then. The American Revolutionary War had nothing to do with religion. It was British colonists being heavily taxed and having no say in government about it.

        The US Constitution was about church/state separation at the 1st Amendment. For those who haven’t read it,

        “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

        In Everson v. Board of Education (1947), the U.S. Supreme Court incorporated the Establishment Clause (i.e., made it apply against the states). In the majority decision, Justice Hugo Black wrote:

        The “establishment of religion” clause of the First Amendment means at least this: Neither a state nor the Federal Government can set up a church. Neither can pass laws which aid one religion, aid all religions, or prefer one religion to another . . . in the words of Jefferson, the [First Amendment] clause against establishment of religion by law was intended to erect ‘a wall of separation between church and State’ . . . That wall must be kept high and impregnable. We could not approve the slightest breach.
        Therefore, no expression of religious faith on religiously-neutral government property is any less than a brazen breach of Constitutional law.
